Course specification
How it works
- Book online — the half-day awareness course, on-site or live online, as one session or two on the same day; or the advanced full day, live online. We'll confirm within 48 hours. We recommend booking at least four weeks in advance to secure your preferred date — live online offers the best availability of dates.
- Your trainer calls beforehand to confirm logistics, and to understand your service and the people you support.
- Half a day (3 hours) or a full day (6 hours), discussion-based, with case studies.
- Certificates are emailed the next day.
What the course covers
Awareness (half day):
- The five principles of the Act
- Assessing capacity, and who decides
- Best interests decisions, and how to record them
- Independent mental capacity advocates
- Lasting powers of attorney, advance decisions and the Court of Protection
- The Deprivation of Liberty Safeguards, and what counts as a deprivation of liberty
- Restraint and restrictions
Advanced (full day) adds:
- The DoLS application process
- 16 and 17 year olds
- A case study, worked through in depth
Who needs this training
Awareness (half day): all health and social care staff who support adults who may lack capacity to make some decisions — care and support workers, nurses and healthcare assistants, in residential care, nursing homes, supported living and domiciliary care.
Advanced (full day, live online): managers, senior staff and anyone who needs in-depth training — including those who carry out capacity assessments, lead best interests decisions or make DoLS applications.
We recommend at least Level 1 literacy and numeracy.
What the law says
The Mental Capacity Act 2005 applies in England and Wales. It sets out five principles for anyone supporting adults who may lack capacity to make a decision: assume capacity unless it's shown otherwise; give all practicable help before deciding someone can't make a decision; an unwise decision doesn't mean a lack of capacity; act in the person's best interests; and choose the less restrictive option. People who work in a professional role or are paid to care must have regard to the Act's Code of Practice.
The Deprivation of Liberty Safeguards (DoLS) apply when a person who lacks capacity to consent to their care is deprived of their liberty in a care home or hospital. Elsewhere, such as supported living, a deprivation of liberty needs authorising by the Court of Protection. In England, CQC's Regulation 11 (need for consent) expects providers to act in line with the Mental Capacity Act where a person lacks capacity to consent. Scotland and Northern Ireland have their own capacity law.
How we assess learning
Learning is checked throughout the session, through case studies, questions and discussion.
Your trainer
Your trainer has used these skills for real, and teaches the Act through the everyday decisions your staff support people with — using case studies, so the five principles make sense on shift, not just on paper.
Logistics

Frequently asked questions
Which version should we book?
The awareness course for all staff who support people who may lack capacity to make some decisions. The advanced course for managers, senior staff and anyone who needs in-depth training — such as those who carry out capacity assessments or make DoLS applications.
Can it be done online?
Yes. The awareness course runs on-site or live online with a trainer, for up to 10 staff online. The advanced course is live online only, for up to 12.
Does it cover the Liberty Protection Safeguards?
The Liberty Protection Safeguards were planned to replace DoLS, but their introduction has been delayed. DoLS still apply, so that's what the course covers.
Does it cover Scotland or Northern Ireland?
No. It covers the Mental Capacity Act 2005 and DoLS, which apply in England and Wales. Scotland and Northern Ireland have their own capacity law.
How is this different from safeguarding adults training?
Safeguarding adults training is about recognising and reporting abuse and neglect. This course is about how decisions are made with and for people who may lack capacity — and when a restriction on someone's liberty needs authorising.
Why not e-learning?
Capacity and best interests decisions are rarely clear-cut. A trainer works through case studies with your team and answers questions about the people they support. For a full group of 12 on the awareness course it works out at around £41 a head.
How quickly can you come?
We confirm bookings within 48 hours, and we recommend booking at least four weeks in advance to secure your preferred date. If you need something sooner, just ask.
