What the law says
In England and Wales, the Mental Capacity Act 2005 says a person isn't to be treated as unable to make a decision just because they make an unwise one. Scotland and Northern Ireland have their own capacity law.
In England, CQC's Regulation 9 (person-centred care) expects care to reflect people's needs and preferences, and Regulation 13 says care must not include control or restraint unless it's necessary and proportionate. CQC's Right support, right care, right culture guidance expects services for autistic people and people with a learning disability to support choice, control and independence. Positive risk-taking is how services put that into practice, with risks assessed and decisions recorded.

- Room: horseshoe or classroom seating — what matters is clear floor space — with a projector screen or blank wall
- The trainer brings: projector, laptop, flipchart and all general training equipment
- Group size: up to 12 per session, on-site or live online
- Timing: agreed with you when you enquire; staff arrive 15 minutes early
- Access: the trainer needs the room 45 minutes before the start

- Live online: a quiet space and a device with camera and audio for each person joining — ideally one device each, and never more than two people per device
- More dates online: live online often has more dates available, so it's worth asking if you need training sooner or have people across several locations

Does this conflict with safeguarding?
No. It shows how to support people's choices while meeting your safeguarding duties.
What if the person lacks capacity for the decision?
The course covers how the Mental Capacity Act applies: if someone lacks capacity for a specific decision, it's made in their best interests, in the least restrictive way. For the law in more depth, see Mental Capacity Act and DoLS.
How should positive risk decisions be recorded?
Clearly: what the person wants, the risks and benefits discussed, who was involved, what was agreed and when it'll be reviewed. The course covers recording decisions and reviews.
How is this different from positive behaviour support training?
Positive behaviour support is about understanding behaviour that challenges and preventing it. This course is about supporting people's choices, including risky ones, without restricting them unnecessarily. The two work well together.
